What Is Martial Law? South Korea Declares State of Emergency

Likewise, the measure, one of the most drastic a government can take, comes in a context of internal political tensions and with direct accusations against the main opposition party, the Democratic Party.

Meaning of Martial Law

First, martial law is a state of exception regulated in the constitution of each country, which grants extraordinary powers to the armed forces and other police forces to guarantee public order. In addition, this regime allows arrests without judicial oversight and applies more severe punishments, including the death penalty in extreme situations.

In general, martial law implies the suspension of fundamental rights of citizens and summary judicial processes. Specifically, it is applied in scenarios of armed conflict, rebellion, or when civil institutions are unable to maintain control. In essence, it seeks to preserve order in emergency situations, although often with a significant impact on individual freedoms.

For his part, Yoon’s declaration did not specify the exact measures to be implemented, but the very nature of martial law suggests a tightening of actions against those identified as “threats to the State”.

Why Does South Korea Declare Martial Law?

On the other hand, in this context, Yoon Suk Yeol’s decision has deep political roots. The president accused the Democratic Party of Korea, which dominates the Parliament, of attempting to destabilize the government through activities that he described as “anti-state” and “pro-North Korea.” In his speech, Yoon denounced that the actions of the opposition, including a motion to impeach prosecutors and the rejection of a government budget proposal, have “paralyzed the affairs of the State.”

In addition, the president declared that the National Assembly, led by the opposition, has become a “monster that undermines liberal democracy.” According to Yoon, these actions are aimed at creating a state of chaos detrimental to public safety and the economic stability of the country. He also stated that his main objective is to protect South Korea

from “North Korean communist threats” and eliminate destabilizing elements.

Meanwhile, the immediate consequences of the declaration are already evident. According to reports from the YTN TV,

the legislators of Parliament faced blockades to enter the premises, which intensifies political tensions. For his part, the president assured that the implementation of martial law will be as non-disruptive as possible for citizens, but made it clear that actions against “anti-state forces” will be decisive.
